WAIVER OF LIABILITY, HOLD HARMLESS, AND RELEASE AGREEMENT

Any person who wishes to shoot, observe, or participate in any activity at TNT Gun Range (the “Range”) must complete this form and accept the following agreements as a condition of, and as consideration for, their participation at the Range. All information supplied will be kept strictly confidential, and is for the sole use by the Range to identify the participant and evidence such participant’s (or such participant’s guardian’s) agreement to hold the Range and its employees, owners, and property owners harmless for any incident or injury that may occur at the Range.



In consideration of being permitted to enter the Range for any purpose, and/or being permitted to shoot and/or observe any activity in the Range, I, on behalf of myself, my heirs, successors, and assigns, hereby:
  1. Release, waive, forever discharge, and covenant not to sue the Range, its landlord and other property and land owners, and each of their respective owners, officers, operators, employees, agents, and servants (collectively, the “Releasees”), from all liability to myself for all loss and/or damage and any claim or demand on the account of any injury, damage, or loss to person or property, including death, whether caused by the negligence or gross negligence of the Releasees or otherwise, while I am on or upon the premises comprising the Range.
  2. Agree to indemnify, save, and hold harmless the Releasees and each of them, from any loss, liability, damage, or cost that such Releasees may incur due to my presence and/or participation in or upon the premises comprising the Range for any purpose, and whether caused by the Releasees or otherwise while on or upon the premises comprising the Range.
  3. Expressly acknowledge and agree that the activities of the Range are very dangerous and involve the risk of serious injury and/or death and/or property damage, and that I am fully aware of the risks and hazards connected with the Range, and that there may be risks and hazards unknown to me connected with my presence and/or participation on or upon the premises comprising the Range.
It is my express intent that this agreement shall bind myself, the members of my family, my parents, and my spouse, if I am alive, and my heirs, assigns, and personal representatives, if I am deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named Releasees. The foregoing agreement is intended to be as broad and inclusive as is permitted by the law of the State of Utah, and if any portion hereof is held invalid, it is agreed that the balance shall continue in full legal force and effect. In signing this agreement, I acknowledge and represent that:
  1. I have read the foregoing release, understand it, and sign it voluntarily as my own free act and deed;
  2. No oral representation, statement, or inducement, apart from the foregoing written agreement, have been made to me by the Releasees:
  3. I am at least eighteen (18) years of age and fully competent;
  4. I will be financially responsible for any damage to the Range and/or the property of the Range, beyond normal wear and tear, caused by my actions;
  5. I execute this agreement for full, adequate, and complete consideration fully intending to be bound by same.
